TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AGGREGATE LIABILITY OF REDARION LLC EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID REDARION FOR THE PRODUCTS OR SERVICES GIVING RISE TO THE CLAIM DURING THE SIX MONTHS PRECEDING THE CLAIM.

15. Dispute Resolution

15.1 Informal Resolution

We will attempt to resolve the dispute internally. If we are unable to resolve the dispute within sixty (60) days, either party may pursue formal proceedings as provided herein.

15.2 Binding Arbitration

At our sole discretion, we may require any dispute arising out of or relating to these Terms or your use of our Services to be submitted to binding arbitration under the rules of the American Arbitration Association. Any arbitration shall be conducted in Sheridan County, Wyoming, unless we agree otherwise.

15.3 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court in Sheridan County, Wyoming, provided that the dispute qualifies for such court and the action is not transferred or appealed to a different court.

15.4 No Arbitration of Class Claims

ANY ARBITRATION UNDER THESE TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED.

16. Force Majeure

Redarion shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, fire, flood, earthquake, storm, epidemic, pandemic, governmental restrictions or orders, labor disputes, strikes, lockouts, interruptions in transportation or communications, power failures, or acts or omissions of third-party suppliers or carriers.

17. Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. The remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, Refund and Return Policy, Shipping Policy, and any other policies referenced herein, constitute the entire agreement between you and Redarion LLC regarding your use of our website and Services, and supersede all prior or contemporaneous communications, promises, and proposals, whether oral, written, or electronic, between you and Redarion.
